Yes. In short, the sale takes place on the reservation, where CAN DELIVER NY is properly authorized to conduct such business and make such sales. The product is then transferred to our delivery service, who transfers the product anywhere in New York State to the customer, without compensation, which is permissible pursuant to governing law.

The longer version:

The place of sale is within the Poospatuck Reservation, wherein CAN DELIVER NY is duly authorized to conduct business. No transactions are permitted outside the reservation. All sales must be pre-paid and completed prior to any items leaving the reservation. After the sale is complete, we transfer the products to our delivery service.

The transfer of items to the customer then takes place at the delivery location requested. The items are transferred from the delivery service to the customer (who is verified to be over 21 years of age) with no compensation made from the customer to the driver, and under the personal threshold limits. As per New York Penal Code § 222.05: "Notwithstanding any other provision of law to the contrary: 1. The following acts are lawful for persons twenty-one years of age or older: (b) transferring, without compensation, to a person twenty-one years of age or older, up to three ounces of cannabis and up to twenty-four grams of concentrated cannabis."
